Data Protection (Jersey) Law 2005

2.  Clients with problems relating to this law can contact the Office of the Data Protection Commissioner. The Data Protection Commissioner is Emma Martins and the Deputy is Paul Vane.

The new law extends data protection controls to certain manual records, as well as electronically processed, personal information.

Requesting information about oneself

3.  Below is a specimen letter that clients can use when seeking information from data controllers.

Dear Sir,

I wish to make an application under Article 7 of the Data Protection (Jersey) Law, 2005. Please supply me with any information which you hold about me to which I am entitled.

If you require further information from me or a fee, please let me know as soon as possible.

If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or other appropriate official.

Complaints under the Data Protection Law

4.  The majority of complaints to the Commissioner's office include unsolicited mailshots. Inaccurate details held by credit agencies and unauthorised disclosure of criminal records.

Computer Misuse (Jersey) Law 1995

5.  This is a law designed to help to protect information stored on computer which came into force on 1 May 1995. Under this and the Data protection Law the Data Protection Commissioner can issue constraints on processing and can enforce access to records. She can prosecute companies who are not registered with the Commissioner's office, and can seize computers and other processing equipment, order access to computer-held data if a company refuses this and stop a company from passing on data to other companies for uses it has not been collected for.

Data Protection Appeals Tribunal

6.  An independent Data Protection Appeals Tribunal was established in December 1999.
