Offence – When someone breaks the law or carries out an illegal act they commit an offence
Splashes - drives though water which then comes into contact with someone / something
Pedestrian - Someone walking on a pavement or road rather than travelling in a vehicle
It is not an offence if a motorist splashes a pedestrian unless it can be proved that the motorist acted carelessly or deliberately.
If it can be proved that the motorist acted deliberately they can be charged with driving without due care and consideration for other road users / careless driving under the Road Traffic (Jersey) Law 1956 as amended.
The Highway Code states you ‘should take extra care around pedestrians, cyclists, motorcyclists and horse riders’ in wet weather.
